How EB-1A is really judged (two steps)
Step one β the criteria check. You submit evidence meeting the plain language of at least 3 of the 10 regulatory criteria (or one major internationally recognized award). This is the part this tool helps you estimate.
Step two β final merits determination. USCIS then weighs all your evidence together to decide whether you have demonstrated sustained national or international acclaim and are "one of that small percentage who have risen to the very top of the field of endeavor." This step is qualitative and discretionary β and it's where many otherwise-qualified petitions fail.
The practical takeaway: don't just collect three criteria β build evidence that shows significance. Citations need field-norm context; awards need explained prestige; leading roles need shown impact. A coherent narrative connecting it all is what wins at step two.
EB-1A vs EB-2 NIW vs O-1 β which is yours?
EB-1A (extraordinary ability) β the highest bar, "very top of your field," but the biggest reward: a green card with no employer and no labor certification, and you can self-petition.
EB-2 NIW β a green card category with a lower bar (three-prong Dhanasar). Needs an advanced degree or exceptional ability; also self-petition, no employer needed. The usual fallback when EB-1A is too tight.
O-1 β a temporary work visa, not a green card. A lower "extraordinary ability" threshold than EB-1A, but it's nonimmigrant and needs a US petitioner/agent. Often a stepping stone to EB-1A later.
Many people pursue O-1 first, build their record, then self-petition EB-1A or NIW for the green card.

A. Any 3 of the 10 clear step one, but at the final merits stage the quality of those criteria matters. Three well-evidenced, high-impact criteria beat five thin ones.
Q. Does premium processing help?
A. Premium processing speeds up the decision (15 business days for I-140) but does not improve your chances β it just gets you the answer faster. It has no effect on the visa bulletin queue if your category is backlogged.
Q. I'm not in STEM or academia β can I still qualify?
A. Yes. EB-1A covers sciences, arts, education, business and athletics. Entrepreneurs, artists, athletes and business leaders qualify under the same 10 criteria, adapted to their field.
